Deferred Deportation Policy of Obama has been blocked by the Judge

In Texas, on Monday, a federal judge has circulated preliminary decree blocking the government of U.S. to enact the executive order of President Barack Obama on immigration adjourn the deportation of around 5 million undocumented immigrants. Andrew S. Hanen, the U.S. District Judge of the Southern District of Texas, has transitorily obstructed the federal government for the implementation of all and any aspects of that order which guarded the millions of people in the country illegally from instant deportation.

He also added that he has agreed with the argument of plaintiff that it is virtually an irreversible action to legalize the presence of millions of people. Hanen mentioned that the administration of Obama, in his governance, has violated the Act of Administrative Procedure.

The preliminary decree implements on the DAPA, Deferred Action for Parents of Americans and Lawful Permanent residents, and growth of the Deferred Action for Childhood Arrivals, both of which declared by Obama in November. DAPA, portion of which was decided to be effective on Wednesday, would be granting work permits defer deportation of undocumented immigrants for three years. Immigrants who are both th U.S. citizens’ parents and those who have been residing in U.S. since 2010.

Ken Paxton, the Texas Attorney General, who is also leading the lawsuit against the administration of Obama, said in one of his statements that the specified decision is the victory of the law rule in America and the critical first step in controlling the lawlessness of Obama. He also added that this decree clarifies that the president isn’t the law towards himself and he needs to function with the elected Congress leaders and provide the sense of satisfaction to the courts in a manner the Founding Fathers conceptualized.

Greg Abbott, the Texas Governor added that the president Obama has abdicated his duty to support the Constitution of United States when he tried to mislead the laws passed by Congress through executive fiat and the decision Judge Hanen uprightly stops the overreach of the president in its tracks.

However, Josh Earnest, the press secretary of White House, in one statement has said that the legal scholars, the Department of Justice, immigration experts and the District court in Washington D.C. have driven that the actions of the president are well under his legal authority. He also added that the decision of the district court unjustifiably prohibits these lawful and commonsense policies from being effective the Justice Department has pointed out that it would appeal that decision.

A petition would be heeded out in New Orleans by the 5th U.S. Circuit Court of Appeals.
