Denial of appeal: Binghamton’s fatal hit and run case

Binghamton’s state court has refused to accept the appeal of an Endicott man to get out of his conviction in a hit and run case. Kevin L. Buie, has been serving in the state prison for 12 to 15 years. Kevin, 31, was sentenced to imprisonment in july 2013 and will be serving for 12 – 15 years. The state appellate divison denied overturning Kevin’s conviction owing to charges of vehicular manslaughter.

The hit – and – run case took place on 15th September in 2012. Kevin was driving a Plymouth Breeze black in color and skipped a red light while turning left from main to Front Street. The crash claimed life of Jonathan Pratt, 35, and proved almost fatal for another pedestrian. As reported by police Kevin fled after hitting but got caught later. His appeal focused on the argument that the police didn’t ask him whether he was influenced by alcohol or drugs at that time and therefore the guilty plea wasn’t knowing and voluntary. The court said that during the plea Kevin made no statements in his defense that were inconsistent with him being found guilty. His appeal decision stated that the court’s record doesn’t contain any clue that he was under effect of alcohol or drugs at the allocution time. he pleaded guilty to 2nd degree assault, vehicular manslaughter and burglary. In the latter incident he unlawfully entered his former girlfriend’s apartment and attacked her as said by the prosecutors. Just a day before the hit – and – run incident, he had been granted a bail on a bond of $20,000 from Broome County jail. According to the state records, Kevin cannot be released until June 2025 from state prison.
